Terms of Use

These Terms of Use (the "Terms of Use") are intended to define the terms and conditions for accessing and using the website available at maisonratti.fr and maisonratti.com (the "Site"), published by WM Expert under the conditions described in the legal notice, by any visitor (the "User"), whether or not they make a purchase on the Site.

These Terms of Use apply irrespective of whether an order is placed, which is governed by the General Terms and Conditions of Sale (GTCS). The relationship between the two documents is set out in Article 14 below.

Simply browsing the Site, on any device (computer, tablet, mobile), constitutes full and unreserved acceptance of these Terms of Use by the User. The User is invited to read them before using the Site.

This acceptance is distinct from acceptance of the GTCS. Placing an order is subject to express and separate acceptance, evidenced by a dedicated checkbox during the order process, in accordance with Article 14.

If the User does not accept these Terms of Use, they are invited not to use the Site.

The Site is accessible free of charge to any User with internet access. All costs relating to accessing the Site (computer equipment, internet connection, software, etc.) are borne solely by the User, who is solely responsible for the proper functioning of their equipment and connection.

WM Expert implements reasonable means to ensure quality access and continuous availability of the Site, without any obligation to achieve this. WM Expert reserves the right to interrupt, temporarily suspend or restrict access to all or part of the Site, in particular for maintenance operations, without notice or compensation.

WM Expert cannot be held liable for any direct or indirect damage resulting from the Site's unavailability, a fault, an error or omission relating to content, or any malfunction linked to telecommunications networks.

The Site is intended for persons with full legal capacity to contract under French law, meaning persons of legal age (18 years or older) who are not subject to a legal protection regime restricting their capacity to enter into civil acts.

The User who uses the Site and, where applicable, places an order there, represents and warrants that they have this full legal capacity.

Any order placed or use of the Site by a minor or by a person lacking the required legal capacity engages the full liability of their legal representative, who is deemed to have authorised and supervised such use. WM Expert reserves the right to request any relevant supporting document and, failing that, to refuse or cancel the order concerned.

Creating a customer account on the Site is optional for purchases made by private individuals (B2C) and is not required to place an order. It is, however, recommended for professionals (B2B) in order to make it easier to track their quote requests.

When creating an account, the User undertakes to provide accurate, up to date and complete information, and to keep it up to date in the event of any change. Any inaccuracy, omission or false statement may engage the User's liability and justify the suspension or deletion of the account concerned.

The User is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account. They undertake to inform WM Expert without delay of any unauthorised use of their account, at contact@maisonratti.fr.

The User undertakes to use the Site in accordance with its intended purpose, in compliance with applicable laws and regulations and with these Terms of Use. To this end, the User undertakes in particular to:

• not use the Site for fraudulent, unlawful purposes, or purposes contrary to public order and accepted standards of decency;
• not impersonate a third party or provide false information;
• not undermine, in any way whatsoever, the proper technical functioning of the Site;
• respect the intellectual property rights attached to the Site and its content, as described in the legal notice and in Article 11 below;
• not use the Site or the information it contains for competitive purposes, for unauthorised commercial purposes, or for unsolicited canvassing.

Any breach of these undertakings may result in the measures described in Article 13 (termination of access), without prejudice to any legal action WM Expert may deem appropriate to bring.

The User is strictly prohibited from:

• attempting to gain unauthorised access to all or part of the Site, its servers, or the systems and networks connected to it;
• introducing, spreading or attempting to introduce into the Site any virus or other malicious code or program, or any code or program likely to undermine the integrity, security or availability of the Site or the data it contains;
• carrying out any extraction or reuse, including automated extraction or reuse (harvesting, scraping, unauthorised crawling), of a substantial part of the Site's content;
• using any robot, script or automated means to access the Site, extract data from it, or disrupt its normal operation, without WM Expert's prior written authorisation;
• undermining, by any means whatsoever, the proper technical functioning of the Site or the security measures in place.

Any confirmed or suspected breach of the provisions of this article may be reported to the competent authorities and may give rise to civil and/or criminal proceedings, in particular on the basis of Articles 323-1 et seq. of the French Criminal Code, without prejudice to the measures for termination of access provided for in Article 13.

The Site provides the User with forms, in particular a contact form and a quote request form intended for professionals. B2B orders cannot be placed directly online: they are the subject of a request via this form, which is then processed by WM Expert.

Information submitted via these forms is used solely to process the User's request, under the conditions described in the privacy policy.

The User undertakes to provide accurate information and not to use these forms for any purpose other than that for which they are intended.

The Site may contain hyperlinks to third-party websites, published and managed by third parties over which WM Expert has no control.

WM Expert accepts no liability for the availability, content or privacy policy of these third-party sites, nor for the products, services or information offered there. The presence of a link to a third-party site does not constitute endorsement by WM Expert.

It is the User's responsibility to exercise caution and to verify the information and terms applicable on any third-party site before use.

The Site uses cookies and trackers under the conditions described in the cookie policy, to which express reference is made for information on the nature of the cookies used, their purposes, their retention period and how to manage the User's preferences.

By continuing to browse, the User acknowledges having read the information relating to cookies and, where applicable, having given consent under the conditions set out in this policy.

All elements making up the Site are protected by intellectual property law, under the conditions detailed in the legal notice, to which reference is made.

As a precautionary clause, in the event that the Site were in future to offer a space allowing the User to submit content (customer reviews, comments, testimonials, photographs, hereinafter "User Content"):

• the User would remain solely responsible for the User Content they publish, and would warrant to WM Expert that they hold all the rights necessary for its publication;
• the User would grant WM Expert, on a non-exclusive and royalty-free basis, the right to reproduce, display and distribute this User Content on the Site and its associated communication media;
• WM Expert would reserve the right to moderate, refuse to publish, or remove at any time any User Content contrary to these Terms of Use, to public order, to accepted standards of decency, or to the rights of third parties.

In accordance with Article 6-I-5 of French law no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), any person who believes that content present on the Site is unlawful may notify WM Expert at contact@maisonratti.fr, specifying the date of the notification, the identity of the notifying party, a description of the disputed facts and their precise location on the Site (URL), the reasons why the content should be removed, and, where applicable, a copy of the correspondence sent to the author or publisher of the disputed content.

WM Expert undertakes to examine any notification received with the required diligence and to act promptly to remove or render inaccessible any manifestly unlawful content of which it becomes aware.

In the event of a serious or repeated breach by the User of these Terms of Use (in particular in the event of a breach of Articles 6, 7 or 11), WM Expert reserves the right to suspend or terminate, temporarily or permanently, without notice or compensation, the User's access to the Site and, where applicable, to their customer account.

This measure does not affect orders already validly placed and fulfilled in accordance with the GTCS, except in the event of proven fraud relating to those orders.

These Terms of Use govern the general use of the Site by any User, whether or not they are a customer.

In the event of a purchase made on the Site, the General Terms and Conditions of Sale constitute the reference contractual document for everything relating to the transaction itself: the characteristics and price of products, order, payment and delivery terms, the right of withdrawal, and warranties and liability relating to the sale. In the event of a contradiction between these Terms of Use and the GTCS on a point relating to the transaction, the GTCS prevail.

These Terms of Use remain applicable to everything relating to access to and use of the Site independently of any act of purchase.

The Site is offered in a bilingual French / English version. The French version of the Site's content, including these Terms of Use, is authoritative. In the event of any discrepancy, inconsistency or difficulty of interpretation between the French version and the English version, the French version shall prevail.

WM Expert reserves the right to amend these Terms of Use at any time, in particular to adapt them to changes in the Site, its features, or applicable regulations. The version applicable is the one in force on the date the User consults the Site.

These Terms of Use are governed by French law, both as to substantive and procedural rules.

In the event of a dispute relating to the interpretation, performance or validity of these Terms of Use, and failing an amicable resolution, the competent French courts shall have sole jurisdiction, subject to the mandatory rules applicable to consumers and the provisions detailed on this point in the GTCS.
